Terms of Use

These Terms of Use form a contract between you and us. They set out how you may use Bix, what we are responsible for, and what you are responsible for. We have written them in plain language so that they can be read and understood without specialist help.

How we handle personal information is set out separately in our Privacy Policy.


1. Who these terms apply to

These Terms of Use apply to anyone who uses any part of Bix – whether you are browsing, viewing an event, making a booking, or running an event. We use "you" throughout to mean whoever is using Bix at the time.

If you are an organisation running events on Bix, you also enter into a separate agreement with us called the Organisation Agreement. That agreement covers matters specific to running events, including fees, payouts, your responsibilities to your attendees, and how we handle the data you put into Bix. These Terms of Use apply to you in addition to that agreement.

By using Bix, you agree to these Terms of Use. If you do not agree, please do not use Bix.


2. About Bix

Bix is operated by Bix HQ Pty Ltd (ACN 693 170 393), with its registered office at Level 1, 580 Church St, Cremorne, Victoria, Australia. We refer to ourselves throughout as "Bix," "we," or "us."

Bix is a platform. The events, activities, sessions, and classes available through Bix are not provided by us – they are provided by organisations who use Bix to manage their bookings. This distinction is important and shapes much of what follows.


3. Bookings: who you are contracting with

When you book an event on Bix, your booking is a contract with the organisation running the event. It is not a contract with Bix. The organisation is responsible for:

  • Delivering the event as described

  • Setting and applying their own refund and cancellation policies

  • Communicating any changes to you

  • Handling complaints, disputes, or other issues relating to the event itself

  • Ensuring their event is safe, accessible, and lawful

Bix's role is to provide the platform that the organisation uses to take your booking. We do not run the events, set the organisation's refund policies, or endorse or vet what is offered. We work to keep the platform operating well, but the organisation is the party with whom you are doing business.

If you have a question about an event – when it starts, what to bring, whether you can change your booking, whether a refund is available – you should contact the organisation directly. Their contact details are shown on the event page and in your booking confirmation.


4. Refunds, cancellations, and changes

The organisation running an event sets its own refund and cancellation policy. Some organisations offer flexible refunds; others do not. The policy that applies to your booking is shown on the event page before you book, and again in your booking confirmation.

If the organisation cancels an event, the organisation is responsible for refunding you. If you cancel your booking, whether a refund is available depends on the organisation's policy. If you have a problem with how a refund has been handled, please contact the organisation directly in the first instance.

We do not issue refunds on behalf of organisations as a general matter. In the limited cases described in section 5 below, where Bix is temporarily holding funds for an organisation and the organisation does not complete the necessary setup, we will refund you. We will let you know if this applies to your booking.


5. Payments

Payment processing on Bix is provided by Stripe. When you pay for a booking, you are paying the organisation through Stripe. Bix is not the seller and does not usually receive your payment.

In some cases, your payment may pass briefly through a Bix-controlled account before reaching the organisation. Where this happens, your booking is still with the organisation, and the organisation remains responsible for refunds and for delivering the event. Further detail on these arrangements is set out in our Organisation Agreement.

If a payment problem arises – for example, your card is charged twice, or a payment does not go through but the booking shows as confirmed – please contact us at [email protected] and we will work with the organisation and Stripe to resolve it.


6. Additional terms from the organisation

Some organisations apply their own terms and conditions to their events – for example, a code of conduct, a photo release, a waiver for physical activities, or a specific refund policy. Where they do, those terms are presented to you at checkout and you will be asked to accept them separately.

Those terms are between you and the organisation. They apply in addition to these Terms of Use, not in substitution for them. Where the organisation's terms conflict with what we say here about Bix's own role, these Terms of Use prevail; otherwise, both apply.


7. Your profile and bookings

You do not need a separate account or password to browse Bix or to make a booking. When you make a booking, your details are associated with a Bix profile linked to your email address. Your profile holds your name, contact details, and a record of your bookings, and is shared across every organisation you book with. We may verify your email address from time to time to protect access to your profile.

You can update your contact details at checkout. Updates apply to your profile across Bix. Your profile is part of how we deliver the bookings you have requested; it does not enrol you in marketing communications, and we will only send you marketing emails if you have separately agreed to receive them.

You are responsible for keeping access to your profile secure. If you believe someone else has accessed your profile, please notify us at [email protected].

Information you provide when booking – including your name, email, phone number, and any additional information requested by the organisation, such as dietary requirements or accessibility needs – is shared with both Bix and the organisation. How we handle that information is set out in our Privacy Policy; how the organisation handles it is governed by the organisation's own privacy notice.

You must provide accurate information. If you book on someone else's behalf, you must have their permission to share their details with us and the organisation.


8. Acceptable use

To keep Bix safe and useful for everyone, you must not:

  • Use Bix to do anything illegal, harmful, or harassing

  • Disrupt, damage, or attempt to gain unauthorised access to Bix or any account

  • Use Bix to send spam, scrape content, or operate automated tools without our permission

  • Use Bix in any way that misrepresents your identity or brings Bix into disrepute

If you do any of these things, we may suspend or close your profile, cancel bookings you have made, and where appropriate report the matter to relevant authorities.


9. Content you post

If you post a comment, review, message, or other content on Bix, you retain ownership of it but grant us permission to display and use it as part of operating the platform. You must not post content that is unlawful, infringes the rights of others, or breaches these Terms of Use.

We do not actively monitor all content posted on Bix, but we may remove content that breaches these terms, and will do so where we consider there is a risk of harm.


10. What we do not warrant

We aim to keep Bix operating reliably, but we do not warrant that the platform will always be available, error-free, or completely secure. The platform may occasionally be unavailable due to maintenance, technical issues, or third-party outages.

We do not warrant that any specific event listed on Bix will go ahead, that the organisation will deliver what it has described, or that the information about an event is fully accurate. Those matters are the organisation's responsibility.


11. Limitation of liability

To the extent permitted by law, our liability to you in connection with your use of Bix is limited. We are not responsible for:

  • The events themselves, including how they are delivered, whether they go ahead, or whether they meet your expectations

  • Refunds, which are the responsibility of the organisation

  • Indirect or consequential losses

  • Matters outside our reasonable control, including outages of third-party services or events of force majeure

Nothing in these Terms of Use limits any rights you have under the Australian Consumer Law or any other law that cannot be excluded. If a court determines that any part of this section is unenforceable, the remaining parts continue to apply.


12. Privacy

Our handling of personal information is set out in our Privacy Policy. The Privacy Policy describes what we collect, how we use it, who we share it with, and the rights available to you.

We do not sell personal information, and we do not use it for marketing without your consent.


13. Changes to these terms

We may update these Terms of Use from time to time, including to reflect new features, changes in the law, or improvements in clarity. Where we make material changes, we will post an updated version with a new "last updated" date and, where you have a profile with us, notify you by email at least 30 days before the changes take effect.

Continued use of Bix after the changes take effect constitutes acceptance of the updated terms. If you do not agree to the updated terms, you may stop using Bix.


14. Closing your profile

You may ask us to close your Bix profile at any time by contacting us at [email protected]. We will respond to closure requests on a case-by-case basis. Closing your profile does not automatically cancel any bookings you have made, does not entitle you to refunds beyond those provided under the relevant organisation's policy, and does not remove records of bookings already made from the organisations you booked with.

We may suspend or close your profile if you breach these Terms of Use or where we have reasonable grounds to believe your use of Bix presents a risk to us, an organisation, or other users.


15. Governing law

These Terms of Use are governed by the laws of Victoria, Australia. The courts of Victoria have jurisdiction in respect of any dispute that cannot be resolved informally.
